In these Terms, "pos2in software" means pos2in point of sale and inventory management products and services, and any features, technologies or functionality provided by those products or services, offered by us from time to time, including the pos2in software.
If you do not agree to any of these Terms, then you should not use the pos2in software. All rights not expressly granted to Users in these Terms are reserved by pos2in.
You must be 18 years or older in order to access and use the pos2in software. You agree to provide true, accurate, current and complete account information, and to maintain and promptly update your account information in order to ensure that it remains true, accurate, current and complete.
You must not: (a) use the pos2in software in any unlawful manner, for any unlawful or fraudulent purpose, or in any manner inconsistent with these Terms; (b) infringe our intellectual property rights or those of any third party in relation to your use of the pos2in software; (c) transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the pos2in software; (d) use the pos2in software in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; (e) collect or harvest any information or data from the pos2in software or our systems or attempt to decipher any transmissions to or from the servers running any pos2in software; (f) disclose or distribute information relating to another User of the pos2in software to any third party, or use any other User's information for any marketing purposes unless you have that User's express permission to do so; or (g) access or register User logins via bots or other automated methods.
We are always striving to improve our Product. In order to do so, we need to measure, analyze, and aggregate how users interact with our Product, such as usage patterns and characteristics of our user base. We collect and use analytics data regarding the use of our product.
We may update or modify this Agreement from time to time, including any referenced policies and other documents. If a revision meaningfully reduces your rights, we will use reasonable efforts to notify you (by, for example, sending an email to the billing or technical contact you designate in the applicable Order, posting on our blog, through your account, or in the Product itself). If we modify the Agreement during your License Term or Subscription Term, the modified version will be effective upon your next renewal of a License Term, Support and Maintenance term, or Subscription Term, as applicable. In this case, if you object to the updated Agreement, as your exclusive remedy, you may choose not to renew, including canceling any terms set to auto-renew. With respect to No-Charge Products, accepting the updated Agreement is required for you to continue using the No-Charge Products. You may be required to click through the updated Agreement to show your acceptance. If you do not agree to the updated Agreement after it becomes effective, you will no longer have a right to use No-Charge Products. For the avoidance of doubt, any Order is subject to the version of the Agreement in effect at the time of the Order.
ALL PRODUCTS ARE PROVIDED “AS IS,” AND pos2in AND ITS SUPPLIERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND, INCLUDING ANY WARRANTY OF NON-INFRINGEMENT, TITLE, FITNESS FOR A PARTICULAR PURPOSE, FUNCTIONALITY, OR MERCHANTABILITY, WHETHER EXPRESS, IMPLIED, OR STATUTORY. YOU MAY HAVE OTHER STATUTORY RIGHTS, BUT THE DURATION OF STATUTORILY REQUIRED WARRANTIES, IF ANY, SHALL BE LIMITED TO THE SHORTEST PERIOD PERMITTED BY LAW. pos2in SHALL NOT BE LIABLE FOR DELAYS, INTERRUPTIONS, SERVICE FAILURES AND OTHER PROBLEMS INHERENT IN USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS OR OTHER SYSTEMS OUTSIDE THE REASONABLE CONTROL OF pos2in. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER pos2in NOR ANY OF ITS THIRD PARTY SUPPLIERS MAKES ANY REPRESENTATION, WARRANTY OR GUARANTEE AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, TRUTH, AVAILABILITY, ACCURACY OR COMPLETENESS OF ANY PRODUCTS OR ANY CONTENT THEREIN OR GENERATED THEREWITH, OR THAT: (A) THE USE OF ANY PRODUCTS WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE; (B) THE PRODUCTS WILL OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM, OR DATA; (C) THE PRODUCTS (OR ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE PRODUCTS) WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS); (D) ANY STORED DATA WILL BE ACCURATE OR RELIABLE OR THAT ANY STORED DATA WILL NOT BE LOST OR CORRUPTED; (E) ERRORS OR DEFECTS WILL BE CORRECTED; OR (F) THE PRODUCTS (OR ANY SERVER(S) THAT MAKE A HOSTED SERVICE AVAILABLE) ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
The fees charged for use of the pos2in software are set out on the Website ("Pricing") and are subject to change. We will endeavor to notify you (by email or by displaying a message when you next use the pos2in software) at least 30 days before increasing the Fees. Fees are charged in advance on a monthly basis and are non-refundable, including if you only use part of a month's subscription for the pos2in software. Unless required by law, we will not provide refunds in connection with the pos2in software. A valid credit card number is required for paying all Fees.
If you are carrying out a free trial of the pos2in software, the free trial will begin on the day that your account is opened and end 7 days later. If you wish to continue to use the pos2in software at the end of the free trial period, you will need to provide valid credit card details.
All Fees are exclusive of all taxes, and you indemnify and hold pos2in harmless against any claims by any tax authority for any underpayment of any sales, use, goods and services, value added or other tax or levy, and any penalties and/or interest.
If you are not 100% satisfied with your purchase, within 7 days from the purchase date, we will fully refund the cost of your order.
We can cancel or suspend your account at any time if, in our sole discretion, you have committed a material or persistent breach of these Terms or any other terms applying to your use of the POS software.
You are entitled to cancel your account with pos2in at any time. You may cancel your account by following the prompts when you are logged into your account through the Website. If you cancel your account before the end of your current paid up month, your cancellation will take effect immediately and you will not be entitled to any refund of Fees paid in advance (unless we agree otherwise).
If your account is canceled: (a) your account will be deactivated or deleted; (b) all of your rights granted under these Terms will immediately come to an end; and (c) all of your data and content may be deleted from our systems immediately. Your content cannot be recovered once your account is canceled. We are not liable for any loss or damage following, or as a result of, cancellation of your account, and it is your responsibility to ensure that any content or data which you require is backed-up or replicated before cancellation.
If you find any kind of bug in the software, pos2in will fix the bug or provide you another updated version of software. Claiming refund money is not an option.
For paid reports, you have to always sync your data to online. Paid reports will be generated based on online data. If you do not sync your data properly, then you will not get accurate reports. pos2in will not take any responsibility in that case.
